Read the TOU carefully as it affects your legal rights and obligations, as well as govern your use of the https://staticdragoncraft.co/. The TOU apply to https://staticdragoncraft.co/ as well as all interactive features or downloads found on https://staticdragoncraft.co/. The TOU do not apply to offline activities by Static Dragon Craft Co unless specifically stated otherwise, or unauthorized 3rd Party interaction. In certain circumstances, both the TOU and a separate Terms of Service setting forth additional Terms and Conditions will apply to a service or product offered on https://staticdragoncraft.co/. These additional Terms of Service and Terms or Conditions will be collectively referred to as “Additional Terms” for the remainder of this text. If there is any conflict between the TOU and any Additional Terms, the Additional Terms will be the final say unless the Additional Terms expressly state otherwise.

You agree to immediately notify us of any unauthorized use of your account or any other security breach you become aware of by sending an email to hello@staticdragoncraft.co with the subject line of “Credentials Unsecure”.

Additionally, as a thanks for registering an account, you will be able to use the coupon code “hello” for 10% off on all orders, with no restrictions. This coupon is only able to be used by registered members, and may not be revoked as long as you have an account with us. You may also use this coupon at all of our Static Dragon Craft Co in person events. You use this code in person by showing us your logged in account page on your phone’s internet browser.

2. ORDERING PRODUCTS & SERVICES

A. Products & Services Offered

A valid electronic payment method that you are authorized to use is required to order and purchase any products or services on https://staticdragoncraft.co/. You will not use any payment method you do not have full legal authorization to. You may be asked to provide information required for your transaction such as payment information, payment card expiration date, billing address, shipping address, etc. By submitting information, you agree to us providing your information to 3rd Parties to facilitate the completion or your order or orders initiated on your behalf to purchase products or services on https://staticdragoncraft.co/. We will not be liable if others acting with or without your authorization use your payment methods to make purchases on https://staticdragoncraft.co/. Some products or services are subject to Additional Terms that will be presented to you before purchase, usually within the description of the product or service.

B. Prices, Colors, & Availability

All prices listed on https://staticdragoncraft.co/ are subject to change. If a product or service is listed with an incorrect price, incorrect information due to typo, incorrect information received from our suppliers, etc., we hold the right to refuse or cancel any order containing said item, whether or not your payment method has already been charged. If your payment method has already been charged, you will receive a full refund to your original payment method if your order was canceled in full, or a partial refund if your order was canceled in part.

The actual colors of products may differ slightly from what is displayed on your monitor because of slight differences in the way individual monitors display colors.

While we offer a variety of products and services on https://staticdragoncraft.co/, we cannot guarantee availability at any specific time. Some products and services may be offered at in person events but not on https://staticdragoncraft.co/, and vice versa. We hold the right to alter our products and services at any time, both in person and online, as well as the right to change contents, features, offerings, accessibility, etc. of https://staticdragoncraft.co/ at any time at our discretion.

C. Order Acceptance Policy

A receipt or other form of order confirmation does not guarantee or show acceptance of your order; it only signifies that we have received your order request. We hold the right to accept or deny your order at any time for any reason. We reserve the right to supply less than the amount you ordered of any item, but we will attempt to notify you via your order email. We will wait 3 business days for you to confirm or deny your order, but if you do not respond, or you respond after we have already bought a shipping label for your order, we may send your altered order anyway. If you deny the altered order before we purchase the shipping label, we will provide a full refund to your original payment method and cancel your order. We may require information or verification before we accept an order. Your order, altered or in fill, is not accepted until we send you shipping information for the order. If we cancel an order, in part or in full, your only remedy is to receive a full refund to your original payment method for a fully canceled order, or a partial refund for a partially canceled order. This only applies if your payment method has already been charged. If your payment method has not been charged, we will not charge your payment method for a canceled order. We also reserve the right to not serve those who have been acting in an abusive manner toward the business as a whole or any of our employees, associates, 3rd party contractors, etc.

D. Payment Terms

For every product or service you order though https://staticdragoncraft.co/, you agree to pay the price listed at the time you submit the order, as well as any sales tax, shipping, handling, etc., after any applicable discounts. Static Dragon craft Co will bill your provided payment method for the order automatically. If payment is not received by us for any reason, you agree to pay all due amounts by our demand.

E. Sales Taxes

Taxes, VAT, customs, shipping, hendling, etc. are not included in the listed individual product prices. Applicable sales tax will be charged to customers within the United States in accordance with our policy at the time of purchase. Customers outside of the United States will be responsible for their own applicable taxes, customs, charges, VAT, etc.

F. Refunds, Returns, Exchanges, & Cancellations

The Refunds, Returns, Exchanges, & Cancellations Policy (https://staticdragoncraft.co/refunds-returns-exchanges-and-cancellations-policy/) that is in place when you place your order will be applied if you attempt to obtain a refund, return, exchange, and cancellation. You should keep track of the Refunds, Returns, Exchanges, and Cancellations Policy that is in place when you place an order. The Refunds, Returns, Exchanges, and Cancellations Policy may be changed at any time at our digression.

3. PROMOTIONS & EVENTS

These special promotions and events may have different eligibility requirements. It is your responsibility to read and understand the rules and determine if you are eligible. If you enter a special promotion or event, you agree to the applicable rules and policies.

You will not in any way contest or aid in contesting the ownership or rights of the materials.

Trademarks and Service Marks like the Static Dragon Craft Co name, logos, and the Static Dragon Craft Co website URLs are owned by Static Dragon Craft Co, and you agree to not display or use any of Static Dragon Craft Co’s Trademarks or Service Marks without our prior written consent. You also may not copy, reproduce, download, or distribute the materials in any way without our prior written consent, unless expressly allowed within the TOU. Any and all unauthorized use of our materials is expressly prohibited. You will agree to and abide by any and all Trademark and Copyright Notices, information, restrictions, ect. Contained in any part of https://staticdragoncraft.co/, or sent to you. You agree to be notified on any additional Trademark and Copyright Notices, information, restrictions, ect. electronically, such as through email.

5. LICENSE TO USE MATERIALS & DIGITAL MEDIA PURCHASES

A. License for Materials

Digital media purchased from https://staticdragoncraft.co/ is not allowed to be used for commercial purposes, unless expressly stated in its purchasing terms or with written permission from Static Dragon Craft Co or its applicable owner. Downloadable digital media may have additional terms.

6. INFORMATION YOU SUBMIT

A. User Content

C. License to Static Dragon Craft Co for User Content

Static Dragon Craft Co has the non-revocable right and license to exploit in any manner whatsoever your submitted User Content, in part or in full, for any purpose in any way. This includes any concepts, techniques, ideas, name, likeness, persona, etc. submitted, including for commercial and marketing purposes. We hold the right to sub-license and authorize 3rd Parties to exercise any or all rights granted to Static Dragon Craft Co under this TOU. Static Dragon Craft Co may publish your User Content in a searchable way that can be accessed by other https://staticdragoncraft.co/ users, as well as the rest of the internet. You will not receive any compensation or royalties from your User Content being used by Static Dragon Craft Co or anyone it sub-licenses to. D. Our Obligations Regarding User Content

We have no obligation to, but we may review, display, monitor, accept, or exploit any User Content. We may, at our sole discretion, alter, edit, delete, distribute, block access, move, re-format, distort, remove, refuse to exploit, etc. User Content without notice or liability. Static Dragon Craft Co reserves the right to treat User Content on https://staticdragoncraft.co/ as content stored at the direction of the user, that we will not edit except to enforce the rights of 3rd Parties and the content restrictions outlined in our User Content Rules when notices of violation are brought to our attention.

Static Dragon Craft Co is not responsible for User Content in any way. We do not endorse or guarantee the completeness, safety, accuracy, or usefulness of any and all User Content.

Static Dragon Craft Co has no obligation or liability relating to any User Content that is viewable on https://staticdragoncraft.co/, including without limitation to liability regarding copyright, trademark, privacy, obscenity, defamation, etc. User Content may be deleted at our sole discretion and you have no right to access or control User Content you provide. We are not obligated to use User Content and you will not receive any consideration, compensation, or royalties for your User Content or any exploitation of it.

E. Your Obligations Regarding User Content

You need to evaluate and bear all risk associated with the use of any User Content. This includes any accuracy, safety, completeness, usefulness, etc. of User Content. Static Dragon Craft Co may not screen User Content, and so you bear any legal responsibility for others’ exposure to any illegal, offensive, objectionable, or indecent content you submit in your User Content.

7. USER CONTENT POLICY

Your participation in creating User Content on the site requires strict compliance with the TOU, including these rules. We have the right , at our sole discretion, to monitor and screen any User Content submitted to https://staticdragoncraft.co/. We also hold the right, in our sole discretion, to disregard any User Content that violates these rules or the TOU, or for any other reason.

7. Do not upload illegal User Content, or User Content that promotes illegal activity. You may be reported to law enforcement.
8. User Content may not promote or instruct others on violence or violent acts. Violence may not be depicted in any way.
9. Be honest and do not misrepresent yourself or your User Content. Do not impersonate any other person, company, government, etc. Do not post User Content that is false, deceptive, fraudulent, misleading, inaccurate, “alternative fact”, or that misrepresents your identity or affiliation with any person or company. Using a name, gender, pronoun, etc. that does not align with your legal equivalent is not fraudulent, as long as done in good faith and not to obscure your identity.
10. Do not post personally identifiable information within your user content, such as legal name, credit card information, login credentials, phone number, email, etc.
11. Do not Dox or post personal information of others, whether they are on https://staticdragoncraft.co/ or not. This includes legal name, credit card information, login credentials, phone number, email, etc. as well as stories or information that are personal or private in nature.
12. Do not collect personally identifiable information from users.
13. Do not break or damage https://staticdragoncraft.co/, its software, its firmware, or its hardware, or its users software, firmware,  or hardware. User Content may not contain harmful software or tools. You may not access any nonpublic portion of https://staticdragoncraft.co/. You may not interfere with or disrupt https://staticdragoncraft.co/, its hardware, its firmware, or its software.
14. We may request proof of permission to submit User Content at any time. If you cannot provide adequate proof, at our sole determination, your content will be removed.

8. USER INTERACTIONS & DISPUTES

Users are solely responsible for their interactions with other users of https://staticdragoncraft.co/, online or offline. Static Dragon Craft Co is not responsible or liable for the actions of any users. We have the right but no obligation to monitor or involve ourself in user disputes.

9. COPYRIGHT POLICY

Static Dragon Craft Co terminates user accounts that repeatedly infringe, at our reasonable discretion.

B.  Procedure

If you believe Static Dragon Craft Co have infringed on the copyright of your work, please contact Static Dragon Craft Co at hello@staticdragoncraft.co, and provide the information required by the Online Copyright Infringement Liability Limitation Act of the DMCA, 17 U.S.C. § 512:

1. The physical or electronic signature of a person authorized to act on behalf or the owner of the allegedly infringed material.
2. Identification of allegedly infringed material or list of allegedly infringed materials.
3. Location of the allegedly infringed material or materials.
4. Contact information of the complaining party.
5. A good faith statement that the complaining party, their agent, or the law did not authorize the use of the allegedly infringed material or materials.
6. A statement that the information within the notice is accurate and the complaining party is authorized to act on behalf of the owner of the allegedly infringed material or materials, under penalty of perjury.

As it is often difficult to determine if intellectual property rights have been violated, Static Dragon Craft Co may email a request for additional information before removing allegedly infringing material or materials. 

If a dispute develops over the owner of the rights, we have the right to remove your content along with the allegedly infringing content prior to resolution of the dispute.

In no event will Static Dragon Crfat Co or its affiliates total liability to you for any and all losses, damages, or causes of action exceed $10.00 USD.

A. Waiver of Injunctive Relief

6. Any misrepresentation made by you

You will fully cooperate as required by Static Dragon Craft Co and its affiliates in defending any claim. Static Dragon Craft Co and its affiliates retain the right to compromise, settle, and pay any and all actions, claims, demands, proceedings, suits, ect. Which are brought against us under the terms and provisions of this section. Static Dragon Craft Co and its affiliates reserve the right to assume exclusive defense and control of any matter otherwise subject to indemnification by you. You will not in any event settle any claim without the prior written consent of Static Dragon Craft Co or its affiliates.

15. TERMINATION & MODIFICATION

Static Dragon Craft Co reserves the right to terminate your access to and use of https://staticdragoncraft.co/ as well as your account at our sole discretion without notice or liability if we believe you are failing to comply with the TOU. We also reserve the right to investigate violations or suspected violations of the TOU, including any violation arising from any emails you send to https://staticdragoncraft.co/ or Static Dragon Craft Co. Any violation or suspected violation of the TOU may be referred to law enforcement.

Upon termination of your account or your access and use to https://staticdragoncraft.co/, or upon demand from us, all rights granted to you by the TOU will immediately cease.

You will:

2. Discontinue linking to and using links to https://staticdragoncraft.co/
3. Destroy all materials from and documentation related to https://staticdragoncraft.co/

B. Modifications

Static Dragon Craft Co will not be liable for and reserves the right to discontinue, modify, suspend, withdraw, etc. temporarily or permanently, on occasion and/or at any time, https://staticdragoncraft.co/ or its materials, in whole or in part, with or without notice.

Information on https://staticdragoncraft.co/ is not intended to be used or distributed by any person, company, organization, etc. in any jurisdiction or country where it would not be in accordance with law or regulation, or where Static Dragon Craft Co would be required to register within the jurisdiction or country. https://staticdragoncraft.co/ is controlled, stored, and operated from offices and servers located within the United States, and makes no claims or warranties that information, products, or services on https://staticdragoncraft.co/ are appropriate or legal for use or access outside of the United States. Anyone accessing https://staticdragoncraft.co/ outside of the United States does so of their own volition, and are responsible for complying with the United States and local governing online conduct and acceptable content. Static Dragon Craft Co reserves the right to limit any person, geographic area, jurisdiction, etc. availability of https://staticdragoncraft.co/ or any content, feature, product, program, promotion, service, etc. available or described on https://staticdragoncraft.co/, for any reason at any time, at our sole discretion. 

17. GOVERNING & CLASS ACTION WAIVER

A. Governing Law

THE TOU AND THE INTERPRETATION OF THE TOU WILL BE CONSTRUED AND GOVERNED BY THE LAWS OF THE STATE OF CALIFORNIA. THIS IS WITHOUT REGARD TO CONFLICTING LAW PRINCIPLES, AND WILL EXPLICITLY NOT BE GOVERNED BY THE UNITED NATIONS CONVENTIONS ON CONTRACTS FOR INTERNATIONAL GOODS SALES, IF OTHERWISE APPLICABLE.

B. Dispute Notice

Prior to initiating arbitration or litigation, you and Static Dragon Craft Co must first provide each other with a written Notice of Dispute. 

This must contain:

1. A written description of the problem.
2. Relevant documents and information supporting your claim.
3. A statement of the specific relief sought.

A Notice of Dispute can be emailed to Static Dragon Craft Co at hello@staticdragoncraft.co. Static Dragon Craft Co will email you a Notice of Dispute via the email associated with your account or order. You and Static Dragon Craft Co will make attempts to resolve the dispute before initiating arbitration or litigation, and you may not initiate arbitration or litigation until the 45 Day Resolution Period, which starts the day after the Notice of Dispute is sent. If an agreement cannot be made within the 45 Day Rosolution Period, Static Dragon Craft Co or you may initiate arbitration or litigation.

C. No Class Actions

TO THE FULLEST EXTENT OF APPLICABLE LAW, YOU AND STATIC DRAGON CRAFT CO AGREE THAT ALL DISPUTES ARE TO BE RESOLVED INDIVIDUALLY AND WITHOUT ANY FORM OF CLASS ACTION. YOU NOR US ARE PERMITTED TO CONSOLIDATE OR JOIN CLAIMS BY OR AGAINST OTHER USERS OR CONSUMERS, OR BE A REPRESENTATIVE OR MEMBER OF A CLASS, OR IN A PRIVATE ATTORNEY GENERAL STANDING, FOR ANY DISPUTE.

D. Fees

If Static Dragon Craft Co or you commence arbitration or litigation, each party will be responsible for all their own fees associated with such. Additionally, if the arbitration, litigation, legal suit, etc. taken by you is ruled to be frivolous, baseless, in bad faith, etc. you will be responsible for all of Static Dragon Craft Co’s fees associated with it.

18. FAILURE TO ACT ON TOU BREACHES

Static Dragon Craft Co’s failure to act on a breach of the TOU or any other Terms, Policies, Conditions, ect. by you or others is not a waiver and will not limit Static Dragon Craft Co’s rights in respect to any breach, past, present, or future. Unless a waiver made by Static Dragon Craft Co is made in writing and signed by a duly authorized Static Dragon Craft Co representative, it will not take any force or effect. Static Dragon Craft Co may assign our rights and duties under the TOU to any party, at any time, without any notice to you. You may not assign these terms except with Static Dragon Craft Co’s written consent. If any part or segment of the TOU is unlawful, void, unenforceable, etc. then that will be severed from the TOU and not affect the validity or enforceability of any other. The TOU will not be construed against Static Dragon Craft Co by the virtue of having written them.

19. UPDATES TO THE TOU

Static Dragon Craft Co reserves the right to add to or modify in part or in whole the TOU, and any Additional Terms, Policies, Conditions, ect. set by us in, at any time, without prior notice. You agree that Static Dragon Craft Co may notify you of these updated terms by posting them on https://staticdragoncraft.co/ and making a post about it on our blog, and that we may send you an email with a link to the updated terms, but are not obligated to. The updated terms may be viewed using the appropriate links on the bottom of the front page of https://staticdragoncraft.co/. You agree that your continued use of https://staticdragoncraft.co/ after posting the updated terms, or engaging in other conduct and activities that are reasonably specifiable, constitutes your agreement to the updated terms. Static Dragon Craft Co will date at the top of any Terms, Policies, Conditions, ect. the last time they were updated. You should review all Terms, Policies, Conditions, ect. for Static Dragon Craft Co and https://staticdragoncraft.co/ before using https://staticdragoncraft.co/. The updated terms are effective at the time of posting, and apply to your use of https://staticdragoncraft.co/ moving forward.
